Acceptance of the general sales conditions
All purchases made on the site www.thinkpiu.com are governed by these sales conditions. Therefore, the customer should read these carefully before carrying out any purchase. M.B. SPORT® can, at any moment and without prior notice, make amendments to these conditions. The general conditions published on the site at the moment of a purchase order are the ones which shall be applicable to that particular order.
www.thinkpiu.com is the online sales outlet for Think+ positive energy, a brand of Specialist Sportswear, made exclusively in Italy.
Detailed descriptions of all the items offered can be found on the site. Product images, where available, are indicative, usually correspond to photographs of the products and are for presentation purposes only. M.B.SPORT® doesn’t guarantee an exact correspondence between the image on the site and the actual product, especially with regard to its actual dimensions and/or colours and/or packaging. In case of differences between the images and the product information sheets, the written descriptions always prevail.

Buying procedure

To make a purchase the Customer must first register on the site by entering his personal information following the instructions of the Registration Programme, and then complete the online order form, following the instructions step by step, and send it to M.B. SPORT®.
The purchase orders should be carefully completed in all parts.
The Customer has to put the desired items in the “Basket” (“Carrello”) and, after choosing and accepting the shipping costs, will be able to proceed to the check-out.
At this point the Customer will see a summary of the details of the purchase order.
The items shown on the site are an invitation to the customer to propose a sales contract. The order sent by the customer is therefore a proposed contract and presupposes complete knowledge and acceptance of the present General Conditions.

Each sales contract stipulated between M.B.SPORT® and the Customer should be considered concluded when M.B.SPORT® sends the Order Acceptance to the Customer’s email address. This confirmation will provide an “Order Number”, to be used in any future communication with M.B.SPORT®; it will also contain, in addition to all the obligatory information required by law, all the details provided by the Customer who should verify their accuracy and immediately correct any eventual errors. Additional costs caused by errors which have not been notified will be at the Customer’s expense. Each order can be viewed on the site by the Customer, in his Member Area.

 

Payment method
The preferred method of payment is via Paypal, an easy and safe way to pay online in a few simple steps. PayPal transactions are carried out on a protected connection. At no time in the purchase procedure is M.B.SPORT® or any other user able to access the information regarding the buyer’s credit card: data are in fact transmitted on a protected connection directly to the site of the bank which is handling the transaction. None of the archives on our site will access or be able to conserve such financial data. PayPal will send an email to confirm each transaction made using this method. With the PayPal system, the customer can pay therefore on a safe server, using a credit card (Visa, CartaSi, Mastercard) or a prepaid card, and also PostePay.
There is absolutely no need for the customer to be registered with PayPal: when the payment page comes up, the user can choose whether to log in to a PayPal account or pay directly by card even if he doesn’t have a PayPal account.


Prices, shipment and billing
Prices for all products are clearly indicated on the site and include VAT. Shipping costs for Italy depend on the weight of the items and are detailed at the time the order is made (for further information please consult the section “Shipping times and costs”). Payment is exclusively via PayPal. There are no extra charges in addition to the total of the order.
M.B. SPORT® declines all responsibility or charge due to delay in carrying out the order or in its delivery, except explicit notification from our Customer Service which can be contacted at customerservice@thinkpiu.com
For all purchases by customers in non-European Community countries, any custom/import fees will be at the buyer’s expense. M.B. SPORT® has no control on the custom charges, which can vary from country to country. Contact the Customs Office of your country to verify the charges.

Billing

The invoice should be requested ticking the appropriate Flag, at the time of the order. The invoice is issued according to the information provided by the client at the time of the order. No changes will be possible after its issue.

Delivery – (Summer Break)

Goods are delivered from Monday to Friday, during normal office hours, except for national holidays and when the company is closed.
We wish to point out that each year the firm closes for a summer break (20 days in August); orders received during this period will be processed when we reopen for business at the beginning of September.
Delivery is considered complete when the item is consigned to the customer at the address specified on the order form. Delivery in all the countries listed on the site will take place without an appointment and at street level. In case of failed delivery at the first attempt, the Courier will leave a note advising that a second attempt will be made the following working day. In case of a second failed delivery, the courier will leave another note with the details of the Post Office where the shipment will be held. The customer can collect the parcel from the PO in the 10 working days, including Saturdays, to be counted from the working day following the date the parcel was handed over to the Post Office. In case of failed collection from the Post Office the shipment will be returned to M.B.Sport®.
30 days after the return of the shipment to M.B. SPORT® because of failed delivery, the contract shall be considered to have expired and the purchase order cancelled according to Article 1456 C.C. At this point M.B.SPORT® will proceed to refund the sum paid by the customer, excluding return and storage charges. The expiry of the contract and the amount to be refunded will be communicated by email to the customer, who should reply indicating the IBAN Code (bank details) where the refund should be credited. In case, within the 30 day expiry period, the customer requests a new shipment of the items purchased, M.B. SPORT® will effect another shipment after payment of the relative shipping charges.

When the courier delivers the goods, the customer should verify:

  • That the number of packages delivered correspond to those written on the Shipping Document
  • That the packaging is intact and undamaged, including sealing material (adhesive tape or plastic straps).

Any damage to the packaging and/or to the product or inexact information on the Shipping Document (including the number of packages etc), must be immediately noted, writing ACCEPTED WITH RESERVE on the courier’s Delivery Sheet. Once the courier’s document is signed, in fact, the client can no longer contest the external defects of the delivered object.

Cases of force majeure or unexpected or inevitable events which delay delivery or render same difficult if not impossible, will allow M.B.SPORT® to divide, postpone or cancel, entirely or in part, the planned delivery or annul the sales contract. In this case it will be up to M.B.SPORT® to immediately notify the customer by email; the customer will then have the right to a refund of the price paid, with no other compensation, of any sort, from M.B.SPORT®.

Satisfied or refunded – Right of Withdrawal
According to Article 5 DL 206/2005, if the customer is a consumer, he has the right to withdraw from the purchase contract for any reason, without the obligation to provide explanations and without additional charges. To exercise the Right of Withdrawal, it is enough to keep a copy of the Shipping Document which accompanied the goods and to complete the Return Form which can be found in the section Satisfied or Refunded.
The Right of Withdrawal loses its validity in the absence of any of the following conditions:

  • The items must not have been washed, used or damaged.
  • The items must be returned to M.B. Sport Snc, Via Lombardi 3, 51031 Agliana (PT), Italy – within 14 calendar days from the date the customer received the goods, after having completed the Return Form and after having received the authorization from M.B.Sport®.
  • The identification tag must be still attached to the item with a single-use seal: this, as well as the box in which it is contained, is an integral part of the item.
  • This right is applicable to the entire purchased item; it is not possible to withdraw from only a part of purchase.
  • To avoid damage to the original package, we recommend, whenever possible, to put it in a second box; labels or adhesive tape should not be applied directly to the original package.
  • According to law the shipping costs for the return of the goods are at the customer’s expense.
  • The shipment is the total responsibility of the customer until it is received at the M.B.Sport® warehouse.
  • In case of damage to the item during transport, M.B.Sport® will immediately notify the customer within 5 working days of receipt. The customer can then claim damages from the courier and obtain reimbursement of the value of the item (if insured).
  • M.B.Sport® can in no way be held responsible for damage, theft or loss of returned items which have been shipped without insurance.

After verifying the above conditions M.B.Sport® will proceed with the refund of the relevant sum as soon as possible and in any case within 30 days from the date on the Withdrawal Form. The refund will be executed via bank transfer: the client should therefore include his bank details on the Request.
On the other hand if the Right of Withdrawal loses its validity in the absence of even one of the above listed conditions, M.B.Sport® will notify the customer by email of the reason for this, requesting to be advised whether or not the goods should be returned to the customer at his own charge.
Attention! The warranties and returns are only applicable to products purchased on www.thinkpiu.com: returns are not accepted with respect to garments purchased otherwise. M.B. Sport® does everything in its power to simplify and accelerate the Return Procedure, for this reason we request that the customer returns the Think+ item to the store where it was bought. The retailer will then send the garment to M.B. Sport®. The M.B. Sport® Guarantee is only valid for items purchased in an authorised point of sale, on presentation of proof of purchase.

Intellectual Property Rights

All brands (registered or not), as well as any literary and artistic works, distinctive sign or denomination, image, photograph, written or graphic text and in general any other immaterial work protected by the laws and the international conventions on intellectual and industrial property, reproduced on the site remain the exclusive property of M.B. Sport® and/or its designates; access to the site and/or stipulation of purchase contracts does not give the customer any rights to this property. Utilization, even partial, of the site content is not allowed except with the previous written authorisation of M.B. Sport®, which remains the exclusive owner of these rights.

Processing of personal data
The customer’s data are processed by M.B. Sport® according to the current laws and standards regarding the protection of personal information, as specified in the section dedicated to the subject ("Privacy Policy").

Applicable laws and Court of jurisdiction
These General Conditions and all contracts stipulated with the customer are governed by Italian Law, except for the application of Community Regulations and International Treaties, if applicable, as well as National Standards for consumer protection.
For any dispute regarding the interpretation, execution, validity or effectiveness of the present General Conditions and any contract stipulated with customers, Prato is the competent Court of jurisdiction.
